Community Reinvestment Act

Community Reinvestment Act Notice (CRA) Under the Federal Community Reinvestment Act (CRA), the Federal Deposit Insurance Corporation (FDIC) evaluates our record of helping to meet the credit needs of this community consistent with safe and sound operations. The FDIC also takes this record into account when deciding on certain applications submitted by us.

Information Collected on the Internet
If you are just browsing through our website, we do not request any personally identifiable Customer Information, nor do we collect unique identifying information about you unless you voluntarily and knowingly provide us that information, such as when you send us an email or complete an application online. If you provide us this information, it is only used internally and in furtherance of the purpose for which it was provided.

As part of providing online financial products or services, we may obtain information about our customers and website visitors from the following sources:

Account Aggregation
Account aggregation sites allow you to consolidate account information from several sources into one online location. In order to provide this service, an aggregation provider may request your passcode and login information. You should ensure that the aggregation provider has appropriate policies to protect the privacy and security of any information that you provide.

If you provide information about your F&M Bank accounts to an aggregation provider, we will consider all transactions initiated by an aggregator using the access or login credentials that you provide, to be authorized whether or not you were aware of a specific transaction.

If you decide to revoke the authority given to an aggregation provider, we strongly recommend that you also change your online password with this Institution. This will help ensure that the aggregation company cannot continue to access your account(s) with us.

We do offer aggregation services through our online banking product. Aggregation allows you to consolidate your accounts from other providers so that you can view all of your accounts in one location. We do not disclose any of the information consolidated through this service. We may use aggregate information, which is not personally identifiable, to better understand the types of account(s) or services which may be most beneficial to you.

Email Policies
When you enroll for our online services, we will send you a welcome email. We may also send emails marketing various products and services offered by this Institution. We will always provide you an opportunity to opt-in or opt-out of marketing related emails.

We will also send security related email notices when you sign-up for email (“notify me”) alerts on your account(s) or whenever you change your password, security question, or email address.

If you agree to accept electronic disclosures and/or online account statements, we may also send you notices of important account updates through email. Beware of Phishing Attempts and Internet Scams
While email is convenient and has a good business use, it can also be misused by criminals for scams and various other fraudulent purposes. “Phishing emails” are frequently used by criminals to entice the recipient to visit a fraudulent website where they try to convince the recipient to provide personal information, such as ATM card numbers, account numbers, Social Security numbers, access Ids and passwords. Some of these fraudulent websites may also be virus laden and can be used to download mal-ware to your computer. Fraudulent websites often look identical to a legitimate site, so it’s important to look very closely at the website address.

Below we have listed a few tips to help protect your personal information on the Internet:

  • Always be wary of links in emails, especially any links in emails purporting to be from this Institution.
  • Please remember that if we send you an email, we will never ask for personal information such as your account number, ATM card number, PIN number, or social security number.
  • Bookmark financial websites and use these bookmarks every time you visit the website.
  • Whenever you enter personal information like your Login ID or password, always look for the lock symbol, or https: in the address bar. Always click on the lock symbol and review the certificate details.
  • Update your Internet browser! Most browsers now offer free anti-phishing tool bars that can help alert you of fraudulent websites.
  • If you send us an email, please do not include any confidential, personal or sensitive information in the email message, as email messages are generally not secure. We do offer secure messaging through our Internet Banking product and you may use this secure messaging feature if you need to send us sensitive or confidential information.
  • Make sure that your computer always has up-to-date versions of both anti-spyware and anti-virus software.
  • If you receive an e-mail that you think could be a scam, delete it immediately or forward the email to spam@uce.gov.

This Institution and our Service Providers have developed strict policies and procedures to safeguard your Customer Information. We restrict employee access to your personal information on a "need to know" basis and we take appropriate disciplinary measures to enforce employee privacy and confidentiality responsibilities. We have established training programs to educate our employees about the importance of customer privacy and to help ensure compliance with our policy requirements.

Furthermore, this Institution and our Service Providers maintain strong physical, electronic and procedural controls to protect against unauthorized access to customer information. Our computer systems are protected in the following ways:

  • Computer anti-virus protection detects and prevents viruses from entering our website, email, and computer network systems.

Privacy of Children
COPPA, the Children's Online Privacy Protection Act, protects children under the age of 13 from the collection of personal information on the Internet. This financial institution respects the privacy of children. We do not knowingly collect names, emails addresses, or any other personally identifiable information from children. We do not knowingly market to children, nor do we allow children under 13 to open online accounts.

Our website may include linked 3rd party sites that would be of interest to children. We are not responsible for the privacy and security practices of these sites. Overdraft Protection Policy

It is the policy of F&M Bank to comply with applicable laws, rules and regulations, and to conduct business in accordance with strict safety and soundness standards. A non-sufficient funds (negative balance) may result from:

a) The payment of checks, in-person withdrawals, ATM withdrawals or other electronic funds transfers, or other withdrawal requests you initiate;
b) Payments authorized by you;
c) The return, unpaid, of items deposited by you;
d) Charging your account for our applicable service charges and fees;
e) The deposit of items to your account which, according to our Funds Availability Policy, are treated as not yet "available" or "finally paid."

We are not obligated to pay any item initiated for payment against your account if your account does not contain sufficient collected funds. Rather than automatically returning, unpaid, all non-sufficient funds items that you may have, if your eligible account type has been open for at least (30) days and thereafter you maintain your account in good standing, which includes at least:

a)Continuing to make deposits consistent with your past practices.
b)You are not default on any loan obligation to us,
c)We reserve the right to require you to pay your outstanding negative balance, including our fees, immediately or on demand, and
d)Your account is not the subject of any legal or administrative order or levy, such as bankruptcy or a tax lien,
we will consider, without obligation on our part, approving your reasonable overdrafts up to your assigned Overdraft Privilege Limit, including our fees.

This discretionary service will generally be limited to a $400 overdraft (negative) balance for free checking account types; or a $700 overdraft (negative) balance for other eligible checking account types. Our normal fees and charges including, without limitation, our non-sufficient funds (NSF) or overdraft (OD) fees; Authorized Overdraft Charge, $30.00; Daily Overdraft Charge, NSF Check Charge– Paying Item, $30.00; and NSF Check Charge – Returning Item, $30.00, as set forth in our Schedule of Fees, will be charged for each transaction initiated for payment from your checking account that does not have sufficient collected funds. Typically, we will charge our normal NSF/OD fee whether we approve an overdraft item for payment or return it unpaid. In addition, we will charge your account a $5.00 per day "daily overdraft charge" for each day that it is overdrawn after five (5) business days.

Our NSF/OD and daily overdraft fees will be included in and count against your assigned Overdraft Privilege Limit of $400 or $700. Whether your overdrafts will be paid or not is at our sole discretion and we reserve the right not to pay. For example, we typically do not pay overdrafts if your account is not in good standing as described above, or if you have too many overdrafts. We may refuse to pay an overdraft for you at any time, even though your account is in good standing and even though we may have previously paid overdrafts for you. You will be notified by mail of any non-sufficient funds items paid or returned that you may have; however, we have no obligation to notify you before we pay or return any item. The amount of any overdrafts, including our fees that you owe us, shall be due and payable immediately, but no later than 30 days.

  • Optional Overdraft Protection Services: We offer an additional overdraft protection service that you may request. This other service is an automatic transfer from another account of your with us. If approved for this optional service, you may save money on the total fees you pay us for overdraft protection services. The fee for this service is $12.00 per transfer.

  • Limitations: We may, in our sole option and discretion, limit the number of your accounts eligible for Overdraft Protection to one account per household and/or one account per taxpayer identification number.

  • Processing Order: Transactions may not be processed in the order in which you conducted them. Transactions will be processed at the discretion of the Banking Officer.

  • You May Opt-Out: You may choose at any time to not participate in the Overdraft Protection Program by notifying one of our Customer Service Representatives.

  • ALWAYS A DISCRETIONARY SERVICE: This discretionary service is intended to assist customers in the event of an unintended overdraft and should not be considered a source of additional funds.
